Terms of Service

Account Setup/Email

We will setup your account after we have received payment. It is your responsibility to provide us with an email address which is not @ the domain(s) you are signing up under. If there is ever an abuse issue or we need to contact you, the primary email address on file will be used for this purpose. It is your responsibility to ensure the email address on file is current or up to date at all times. Providing false contact information of any kind may result in the termination of your account.

Price/Plan Change

The amount you pay for hosting will never increase from the date of purchase. We reserve the right to change prices listed on hostingcove.com, and the right to increase the amount of resources given to plans at any time.

Data Backup/Loss

Your use of this service is at your sole risk. Our backup service is provided to you as a courtesy. Hosting Cove is not responsible for files and/or data residing on your account. You agree to take full responsibility for files and data transferred and to maintain all appropriate backup of files and data stored on Hosting Cove servers. Backups will not be provided for accounts that have been suspended or terminated for any reason unless otherwise agreed to in writing by Hosting Cove.

We backup your data on a regular basis in case of a hardware or software fault. In the case of a fault on our end we will provide backups at no cost. Any requests to restore a backup will be charged a service fee unless you can provide your own personal copy.

Content

All services provided by Hosting Cove may only be used for lawful purposes. The laws of the United States of America apply.

The customer agrees to indemnify and hold harmless Hosting Cove from any claims resulting from the use of our services.

Use of our services to infringe upon any copyright or trademark is prohibited. This includes but is not limited to unauthorized copying of music, books, photographs, or any other copyrighted work. The offer of sale of any counterfeit merchandise of a trademark holder will result in the immediate termination of your account. Any account found to be in violation of anothers copyright will be expeditiously removed, or access to the material disabled. Any account found to be in repeated violation of copyright laws will be suspended and/or terminated from our hosting. If you believe that your copyright or trademark is being infringed upon, please email abuse@hostingcove.com with the information required.

Using a shared account as a storage device is not permitted, with the exception of one cPanel backup of the same account. Please do not take backups of your backups.

Examples of unacceptable material on servers include:

Topsites
IRC Scripts/Bots - IRC is allowed on VPS and Dedicated plans
Proxy Scripts/Anonymizers
Pirated Software/Warez
Image Hosting Scripts (similar to Photobucket or Tinypic)
AutoSurf/PTC/PTS/PPC sites
IP Scanners
Bruteforce Programs/Scripts/Applications
Mail Bombers/Spam Scripts
Commercial Banner-Ad services (ad rotation)
File Dump/Mirror Scripts (similar to rapidshare)
Commercial Audio Streaming (more than one or two streams)
Escrow/Bank Debentures
High-Yield Interest Programs (HYIP) or Related Sites
Investment Sites (FOREX, E-Gold Exchange, Second Life/Linden Exchange, Ponzi, MLM/Pyramid Scheme)
Sale of any controlled substance without prior proof of appropriate permit(s)
Prime Banks Programs
Lottery Sites
MUDs/RPGs/PPBGs
Sites promoting illegal activities
Forums and/or websites that distribute or link to warez/pirated/illegal content
Bank Debentures/Bank Debenture Trading Programs
Fraudulent Sites
Mailer Pro

We reserve the right to refuse service to anyone. Any material that, in our judgment, is obscene, threatening, illegal, or violates our terms of service in any manner may be removed from our servers (or otherwise disabled), with or without notice.

Note: though we reserve the right to terminate your account, Hosting Cove will try to take every effort to contact clients of abuse prior to termination so that issues can be resolved.

Potential harm to minors is strictly forbidden, any site found to host child pornography or linking to child pornography will be suspended immediately without notice. The police will be notified upon proof of the report.

Payment

As a client of Hosting Cove, it is your responsibility to ensure that your payment information is up to date, and that all invoices are paid on time. Hosting Cove generates an invoice 5 days prior to your due date as well as providing a 7 day grace period from the time the invoice is generated and when it must be paid. Any invoice that is outstanding for 5 days and not paid will result in a %10 charge with a $4 late fee minimum and/or an account suspension until the account balance has been paid in full. The late fee is applied in addition to whatever else is owed to Hosting Cove for services rendered. Access to the account will not be restored until payment has been received. After 15 days all shared hosting accounts are terminated, backups will not be provided. Dedicated server invoices are generated 5 days prior and are due on the due date of the service and will be terminated immediately if not paid for.

Customer Support

Currently there are two options for customer support.
1) Phone Support: This service is provided during business hours US central time GMT -5.
2) Email/Ticket support: monitored at all hours and you can expect a response quickly.

Cancellations and Refunds

Hosting Cove reserves the right to cancel, suspend, or otherwise restrict access to the account at any time with or without notice.

Only first-time accounts are eligible for a refund within the first 30 days if you are not satisfied with the service. For example, if you've had an account with us before, canceled and signed up again, you will not be eligible for a refund or if you have opened a second account with us.

Refund requests for top level and ccTLD domain names are not allowed. All domain sales are final.

Dedicated Servers, VPS Servers, and VPNs do not qualify for a 30 Day refund.

Any checks, mailed payments, bank transfers, or money orders will only be refunded as credit toward your user account.

Abusive clients or accounts found to be abusing the server or network will not be qualified for a refund.

Limitations

In no event shall Hosting Cove or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption,) arising out of the use or inability to use the materials on HostingCove's Internet site, even if HostingCove or a HostingCove authorized representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.
